As per Rule No.6A Export Services, ITPO is exempted from collection / deposit of Service Tax in respect of Fairs organized abroad.
  • If yes, please provide the reason for this exemption for the services rendered on fairs out of India.
Please provide copies of all departmental records, documents, e-mails, opinions, advices, reports papers, file notes, extracts or certified copies of the documents or records pertaining to the above information sought.
As per Rule No.6A, Export Services, the recipient of service should be located in India.  Accordingly, for the fairs organized abroad, ITPO need not charge service tax.  Photocopy(6 page) of the relevant rule is available with P.I. Cell, ITPO, New Delhi – 110 001.
2. ITPO/PIC/03/02/2014 Shri R.S. Dogra, New Delhi
  • Please provide me a policy for nomination of officials in ITPO for foreign deputation.
Policy for nomination of officials in ITPO for foreign deputation is as under:
  1. Selection of Fair Officer/Project Team based on performance delivery, merit, suitability including financial and Vigilance clearance. Seniority will also be given due weightage though merit will remain the main guiding factor.
  2. Non inclusion of officers who have requested not to be considered for foreign deputation.
  3. Recommendation by Committee and approved by CMD.
  4. Team members nominated by the Fair officer/ designated HOD/ Supervisory officer.
  • Names of officials belong to SC/ST categories from Assistant to GM nominated for foreign deputation from the year April 2008 to February 2014 (year-wise)
Details(6 page)  belonging to SC category and details (1 page) belonging to ST category of officials nominated on foreign deputation, (indicating   √ mark) showing previously nominated /year-wise nominated for the period 2008-09, 2009-10, 2010-11, 2011-12, 2012-13 and 2013-14, can be obtained from Public Information Cell, India Trade Promotion Organisation by depositing Rs.14/- towards photocopying charges of 7 page @ Rs,.2/- per page. Please also note that rest of the officials have not been deputed.

  • Last Board of Directors Meeting held in 2013-14 along with Agenda items and thereof disposal.
  • Agenda items held on 1981 including recruitment Rules to the post of Sr. Steno in 50% 50% quota with typing Stenographic test and without typing stenographic typing test of obtaining the approval of BODs vide order No. 84/82 dated 27.2.1982 – only Agenda items may be provided.

In this context, this is to inform that India Trade Promotion Organisation, as a firm policy, does not permit anyone to organize marriage and other religious ceremonies and rituals as well as functions having such connotions at any place in Pragati Maidan.  However,  ITPO provides Halls for Exhibition and Conference/ Seminar purpose.  Details of these Halls  and rates of licence fee, etc.  are available on our Website: www.indiatradefair.com     
6. ITPO/PIC/03/06/2014 Rajender Singh Pal, New Delhi Copy of document on which ITPO Employees Union agreed with ITPO Management to take group medi-claim Policy for ITPO employees in the year 2013. This is to inform you that no such document exists/available.
7. ITPO/PIC/03/07/2014 Shri S.C. Byragoni, Secunderabad
  • Is the information given  in the website Proactive disclosure under Section 4(1) (b) by the Department of Commerce Ministry of Commerce and Industry is updated along with the names, email addresses, telephone numbers, Public Authorities designated and employees?, If updated when it is last updated under what official website?
  • ITPO’s concerned Department arranges the updation of information on our Corporate    Website: www: indiatradefair.com and RTI Website: www.rtia-itpo.org.in and the last updation was made on 21.3.2014 on RTI website.

The Chief information Commission (CIC) directed the CPIO Ministry of   Commerce & Industry, Department of Commerce (DOC) asked to file written         submissions before the Commission within three weeks from the date of order on 05.09.2014.  Please provide the certified copies of your reply to CIC. Please provide the Certified copies of latest decisions/orders of the Supreme Court and High Courts of India on following Export Promotion Councils (EPCs) are under purview of “Public authority” as defined in the RTI Act 2005.

2.  SAARC Trade Fair, Karachi, 2006
  • Name of the team leader and the team members.
Shri Tanvir Ahmed and Shri V. Narayanan were team leader and team member respectively. Copy (1 page) of order enclosed.
  • Amount which was not recovered from NRDC on account of their participation charges.
The amount which was not recovered from NRDC on account of their participation in SAARC Trade Fair, Karachi, 2006 is Rs.4,040/-.
  • Details of amount which were recovered from the team leader and team members respectively due to non recovery of amount from NRDC in respect of SAARC Trade Fair, Karachi, 2006.
As on date, an amount of Rs.4,040/- lying unrecovered due to various letters/ mails received from M(VN) of ROC. This pertains to TDS and M(VN) has stated that they have forwarded TDS certificate.
  • If not, details of the Office Order or the approval of the competent authority under which the recoverable amount from NRDC got written off/settled.
Nil. Since, the amount pertains to TDS and the other member of Team is still in Service of ITPO.  We have shown the amount against M(VN).
3.  SIAL Food Fair, 2000
  • Name of the team leader and the team members.
Shri Tanvir Ahmed and Shri S.K. Jha were team leader and team members respectively. Copy (1 page )of order enclosed.
  • Details of refund of VAT amount the subsidy from MFPI related to SIAL Food Fair, 2000 not received by ITPO.
Details of refundable VAT amount in respect of Sial Food Fair is as under: Euro 2251.17 and Euro 12417.74.  It is clarified that this amount has been reversed in the books of account and treated as expenditure with the approval of CMD. Copy of approval (2 page) & voucher (1 page) is enclosed.
  • Name of the team leader/team members from whom the recoverable amount was recovered by ITPO, on account of non receipt of VAT refund and subsidy amount from MFPI.
No amounts were recovered from the team members.

4.  Mini India Show –Czeck Republic 2005.

Order No.54(33)/ITPO/FFA/2010-11 dated 15.10.2010 is not available.  However, efforts are being made to locate the same and would be provided in due course.
(c)  Details of the office order or approval of competent authority  vide which them amounts indicated in the order no. 54(33)/ITPO/FFA/2010-11 dated 15-10-2010 settled. Copy (3 page) of the approval of competent authority for expenditure under the Head ‘H&C’ amounting to Rs.2,42,668/- & Rs.19,529/- is enclosed..
5. (a) Details of outstanding amount shown against the name of Ms. Naseem Ishaque, GM as on 1.1.2012 and settlement, thereof. (b)   Copies of the approvals granted by the competent authority for  settlement of non-recovered amounts of the fair may be provided. As per records of foreign fairs accounts Division, the following two amounts were outstanding as on 1.1.2012: i)VAT – Euro 28028.20 (AFL Artigiano de fiera fair Milan, Italy Dec.2009) – the amount has been received vide voucher No.11000258/15.03.2012. ii) VAT-  Euro 66706.80 (AFL Artigiano de fiera fair Milan, Italy – Dec. 2010) – the amount has been received vide voucher No.12000238/ 14.03.2013 (copies  11 pages attached)
6.  Details of action taken and outcome thereof of my representations dated 23.10.2013, 5/2/14/3/2014 2014, 12/2/2014, 21/2/2014, 5/3/2014 addressed to OSD(BLM) and note dated 14/03/14 addressed to ED with regard to seeking certain information on the recovery made by Finance Division. Photocopies (27 pages) of relevant documents are enclosed.

9 ITPO/PIC/03/09/2014 Shri Suresh Kumar, New Delhi During June 1995, 5 posts of Assistant Manager (Now Deputy Manager General Cadre) were filled by general candidates by diverting from D.R. Quota for SC/STs.  These posts were de-reserved and filled by general candidates from amongst PAs without the approval of the competent authority i.e. BOD. The following information may please be provided:
  • Whether posts were diverted from DR quota (reserved for SC/STs) to DP quota.
      No.
  • Whether the posts were de-reserved and filled by general candidates (PA’s).
Not applicable.    
  • Whether consent of the Liaison Officer and SC/ST Commission was sought.
  • Whether the matter regarding de-reservation was forwarded through MOC to SC/ST Commission.

It has been conveyed by the concerned Division that the documents sought are not available in the file.

11. ITPO/PIC/03/11/2014 Shri R.L. Kain,  Delhi Please arrange to supply the following information, documents and allow inspection of records for declaring 24th December as National Consumer Rights Day after Rajiv Gandhi being an alleged architect of the Consumer Protection Act, 1986 and I reserve my right to revise my RTI application as per new requirements that may be treated as part of this application.
  1. Whether 24th December has been declared as National Consumer Rights Day after Rajiv Gandhi being an alleged architect of the Consumer Protection after having been enacted by Parliament, received the assent of President on 24th December 1986 and notified it on 15.4.1987.  Whether it is a fact that an advertisement was appeared first time in the Hindustan Times at page 9 on 24th December, 2013, if yes, what criteria has been laid down by the Government of India for declaring any day or any event as National Day on any issue or on any national personality, please arrange to supply the copy of the policy governing the criteria fixed on the subject and when was Rajiv Gandhi declared as National leader by the Government of India,  please supply the copy of the decision together with all these information?  Whether executive hierarchy had moved this proposal or the political hierarchy had directed the executive hierarch to move this proposal,  please apprise in categorical terms with records in your support.
  2. Whether it is true and correct that Consumer Protection Act was enacted by Parliament on 24th December, 1986 as a result of limited options were available to consumers in different manner in different statues viz. the IPC 1860, CCP, 1908, Indian Contract Act, 1972 Sales of Goods Act, 1930, the Standards of Weights and Measures Act, 1976, Motor Vehicles Act, 1988, the Prevention of Food Adulteration Act, 1955  and the Monopolies and Restrictive Trade Practices Act, 1969 and after noticing the difficulties this new enactment was came into being, if yes, what is the new in this Act and as to how the question of honouring any personality arises for his petty achievement after a lapse of 27 years for enacting a law to facilitate the consumers in different manners?
  3. Whether any request or demand was received by the Ministry of Consumer Affairs from any public organizations or from party in power or from the Chairperson National Advisory Council or from any nodal ministry for naming 24th December as National Consumer Rights Day, if yes, please arrange to supply the copy of the request or demand received by Government, if no such demand was received from public then what was/is the justification for declaring 24th December as National Consumer Rights Day to perpetuate his memory, whether his birthday and death anniversary have been named, if yes, what are the details thereof and what are the justification thereof?
  4. Whether any approval was accorded by the Cabinet to dedicate this petty event after Rajiv Gandhi, if yes, please arrange to supply the copy of the Cabinet Note sent to Cabinet for approval together with its decision and the copy of the noting sheet containing the approval of Secretary and Minister of Consumer Affairs, if no such approval was obtained then what is the justification for declaring 24th December as National Consumer Rights Day in memory of Rajiv Gandhi after lapse of 27 years?
  5. Whether the Statement of Objects and Reasons of the Consumers Protection Bill contained any proposal for dedication of the statue in the name of Rajiv Gandhi, if not then under what circumstances this statute has been name after Rajiv Gandhi and how many similar statues were named as per the wishes of the party in power or on public demand or as per the wises of parliamentarians, if yes, please arrange to supply the complete details of statues named after any personality since after independence, if no such practice is in existence then what were the compelling circumstances for declaring the small event of National “Consumer Rights Day after the name of Rajiv Gandhi.
  6. Whether the  Constituent Assembly while adopting the  Preamble to the Constitution on 17th October, 1949 rejected the amendment proposal for installing Mahatma Gandhi as the Father of the Nation, in part one of the Draft Proposal of Dr. B. R. Ambedkar, the Chairman of the Drafting Committee and Chief Architect of India Constitution also turning down the childish demand of slogan mongering Congressmen to start with the new era of Mahatma Gandhi in the third part of the Preamble on the basis of opinion expressed by the Chairman of the Constituent Assembly that nobody can be bigger than the Constitution and hence, no name of any personality could be included in the Preamble of any Constitution of any country,  if yes, then under what circumstances the ibid bill having been declared as statute was dedicated to the memory of Rajiv Gandhi, please elucidate reasons, whether an individual is bigger than the Constitution, if yes, please quote the lawful authority, if no such authority exists, then withdraw this unconstitutional action of Ministry of Consumer Affairs?
  7. Whether it is a fact that Mahatma Gandhi had been declared the Father of the Nation by the Government of India till date in view of Article 18 of the Constitution of India and also in view of the deliberations took place in the Constituent Assembly on 17.10.1949 on the contrary  he is being constantly crowned unlawfully and illegally with the unconstitutional connotation in official documents and advertisements, if yes, what is the justification for using unconstitutional terms for Gandhi?
  8. Whether it is fact that the impugned Consumer Protection Act 1986 has since been amended in 1991, 1993 and 2002 and at no point of time, Government had expressed its will to decorate Rajiv Gandhi with this honour, if yes, then what is justification now for decorating him for this routine exercise of getting the ibid bill passed?
  9. Whether it is a fact that Cabinet Secretariat has issued orders/instructions not to name any more Central Schemes, plans, institutions, events etc. etc. after the family names of Nehru, Indira Gandhi and Rajiv Gandhi which were already out of proportion, if yes, what are the details thereof and how many  schemes, plans, institution and events had already existed in his name or in the name of his family right from Nehru to Indira Gandhi, Please arrange to supply the complete details thereof under what circumstances present gesture has been extended in favour of Rajiv Gandhi for the event of 24th  December as National Consumer Rights Day has been dedicated after him, please arrange to supply the complete justification with records on file?
  10. Please apprise with complete details in how many cases various Acts have been dedicated by the various Central Ministries after the memory of any other leaders, Prime Ministers or Presidents, since after independence and what objectives have since been achieved or obtained by the Government for dedication of such statues?
  11. Whether it is a fact that at the end of the calligraphed Constitution of India (English) a mandatory declaration under Section 3 of the Press Registration of Books Act, 1867 with which the unwarranted dynastic particulars of Prem Behari Narain  Raijada (Saxena) has since been published in original set and also contained his nick name on each and every page written by him and names of other artists have been recorded on the pages which were designed by them, if yes, under which provision of the Constitution and by whose authority this unconstitutional act was done, may please be apprised with records?  This information has been sought as all illegalities go unnoticed as they are out of public domain and individual Ministry always do such acts unobtrusively without any authority of law, hence this such information are sought so as to bring them under public domain.
In this context, this is to inform that the information sought does not relate to India Trade Promotion Organisation.
12. ITPO/PIC/03/12/2014 Shri Banarasi Ram, Delhi Inspection of Roster Register DR/DP to the post  Jr. Steno/Sr. Steno/PA and PAs promoted to the post of the then Asstt. Manager w.e.f. 01.03.77 to 31st March 2014. Please note that formula to the post of Sr. Steno, Steno Post 50% without Stenographic typing test – Seniority-cum-fitness basis and 50% qualifying steno typing test – Roster Register respectively- as per guidelines framed.  Agenda item – Amendment of Recruitment Rules to post of Sr. Stenographer – 50% +50% quota without test/qualifying typing test make available during the inspection. Please ensure that any Jr./Sr./PA and PA to DM may not be disappeared from the Roster list as on name of Mr. M.L Mukhi, AM not shown in the list of AM at serial no. 115 vide ITPO/PIC/07/16/13 copy enclosed. In the post category SC/ST/OBC/ Gen. may be recorded.” This is to inform you that Shri Chandi Prasad Maithani, Executive, ITPO, New Delhi, has been nominated to arrange inspection of the said documents by you on 23rd   May, 2014  at 1500 hrs.  The inspection will be conducted in Public Information Cell, India Trade Promotion Organization, Pragati Bhawan, Pragati Maidan, New Delhi- 110 001.      Regarding second part of your query, this is to inform that Shri M.L. Mukhi was promoted to the post of Dy Manager from the feeder channel of Sr. Investigator and not from PA.
