RIGHT TO INFORMATION ACT -ITPO

Details of Queries/Replies for the month of September 2013 under RTI Act :

1. ITPO/PIC/09/01/2013 Sh. Suresh Mehto How many persons have obtained employment in your department/ organization on the basis of Scheduled Tribe Certificate (i.e. Kharia, Kisan, Kharwar and Gorait castes) in the district of Saran, Siwan and Gopalganj of Bihar State.  Please supply the copy of their caste certificate duly verified by the concerned issuing authorities One person has obtained employment on the basis of Scheduled Tribe Certificate, who belongs to Kharia community of Distt. Saran (Chapra), Bihar.  Photocopy (1 page) of the ST Caste Certificate is enclosed.  
As per records available in office of District Magistrate of above districts, no Scheduled Tribe Certificate has been issued in respect of above mentioned castes.  They have obtained employment by producing fake /forged caste certificate.  They have snatched the right of Scheduled Tribes.  Necessary action may be initiated against the person who have obtained employment by producing /forged caste certificate. You are requesting for initiating action in the matter. Seeking/initiating action is not covered under “Information” as defined u/s 2(f) of the RTI Act, 2005.  The applicant can only seek information, which already exists in material form with the Public Authority.  Hence, for taking any action, you may approach the appropriate authority.
It is also mentioned that District Welfare Officer, Saran has confirmed that number of Kharia, Kisan, Kharwar and Gorait in the above mentioned districts is zero and no certificate has been issued from their office in respect of above castes. It is also mentioned that investigation has been done by CBI team in regard to authenticity of above mentioned castes and they have given a statement that in the above mentioned districts the number of Kharia, Kisan, Kharwar and Gorait is zero which has been published in HindustanTimes on 31st July, 2010 and 23rd Septmber, 2009, Patna. You are requested that necessary action may be initiated against the person who have obtained job on    the basis of above castes so that genuine people      should not be deprived from their rights.
2. ITPO/PIC/09/02/2013 Sh. Sapneswar Behera Ref. order No.4-ITPO(28)/E.I/2012 regarding promotion to the post of Sr. Stenographer  - competitive quota. Certified copy of all the pages of File No.4-ITPO(28)/E.I/2012 i.e. notings till date and all correspondence pages pertaining to promotion of Sr. Stenographer – competitive quota. This is to inform you that you may inspect the concerned file on 08th October, 2013 at 4.00 p.m..  Documents identified during the inspection can be obtained on payment basis.  Shri Chandi Prasad, Executive, ITPO, has been nominated to arrange inspection of the relevant file.  The confidential documents, which are exempt from disclosure, shall be severed as per Section 10 of the RTI Act, 2005. Please also note that for inspection of file(s), no fee is charged for the first hour and a fee of Rupee five is charged for each subsequent hour (or fraction thereof) thereafter.

What are the methods adopted for cleaning of tanks and sumps at your organization presently?  And how frequently you are cleaning them? At present, the tanks/ sumps as mentioned above are cleaned through contract & the frequency of cleaning of the tanks for filtered water is 4 times in a year and the tanks feeding water to AHU & toilets are cleaned twice in a year.
What are the tests conducted after cleaning of tanks & sumps to ensure that the tanks & sumps are bacteria free/disinfected/cleaned? Since the water supply to the tanks/sumps meant for drinking is directly from DJB lines, hence testing is not required.
What is the amount spending on cleaning of water tanks/sumps in a year? Rate contract details of previous tenders allotted of last two episodes. The amount kept for cleaning of above tanks presently i.e. during 2013-14 is Rs.1,76,555/- i/c 4.944% service tax. Generally item rate contracts are adopted.  The rate contract details are as under:
  1. 2011-12 –Item rate contract amount to Rs.87,169/- (total spent)
  2. 2012-13 – Item rate contract amount to Rs.1,00,185/- (total spent).
Who is the Person/Department responsible for maintaining the tanks/sumps at your organization and their contact details? The Manager (Civil)/ Engineering Division, India Trade Promotion Organization, Pragati Maidan, New Delhi - 110 001.
What are the budget allocations of your office for cleaning the water tanks/sumps? During 2013-14, the budget allocated for cleaning of tanks is Rs.1,76,555/- i/c 4.9444 % service tax.
4. ITPO/PIC/09/04/2013 Sh. Mohan Lal Jonwal The accreditation by the nation Accreditation board of Hospitals (NABH) is mandatory requirement for empanelment of a hospital under the India Trade Promotion Organisation Scheme. No.
Kindly provide me certified copy of rules/guidelines for empanelment with the India Trade Promotion Organisation. Copy (1 page) of Guidelines for empanelment with ITPO can be obtained from Public Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi, by depositing Rs.2/- towards photocopying charges of 1 page @ Rs.2/- per page.
Kindly provide me certified copy for empanelment with India Trade Promotion Organisation. The hospital was taken on panel in 1993 and adopted from the list of Private Nursing Homes and Private Hospitals registered with Directorate under Delhi Nursing Homes Registration Act, 1953.
5. ITPO/PIC/09/05/2013 Sh. Sanjeev Kumar Kindly provide the certified copy of Recruitment Rules (RRs) for the post of Jr. Steno and Sr. Steno applicable from January, 2008. Copies (2 page) of Recruitment Rules for the post of Jr. & Sr. Steno, are available with Public Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi – 110 001.
Who is the authority to approve/change the RRs for the post of Sr. Steno? Board of Directors of ITPO.’
Kindly provide the certified copy of agenda and Extracts of the Minutes where the recruitment rules/promotion rules for the post of Sr. Steno were approved applicable from January, 2008. Copies (4 page) of extracts of Minutes, Agenda, are available with Public Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi – 110 001.
Whether the promotion criteria to the post of Sr. Steno is 50% under Seniority quota and 50% under test quota? Yes.
Kindly provide the certified copy(s) of the approval of the competent authority and Board of ITPO wherein it was approved that under competitive test (for the promotion to Sr. Steno.) quota the senior candidate will be selected only on the basis of just qualifying the steno text criteria than a junior candidate who will be on merit will not be considered. 50:50% quota has been provided for Seniority and Test respectively as per RRs. He may refer to RRs given at Sr.No.1 above.
Kindly provide the certified copy of the rule adopted for promotion of stenographers pm the basis of competitive competitive test held on 6th February, 2013. Copy (1 page) of O/O No.389/2006 dated 05/04/2006 are available with Public Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi – 110 001.
Kindly provide the certified copy of the rule adopted for preparation of panel for promotion to Sr. Stenographers in regard to competitive test held on 6th February, 2013.
Whether there was an clear vacancy under general category available during October 2012 when notice was issued to Jr. Stenographers for preparation for shorthand/ typing test for  for promotion to the post of Sr. Steno? For conducting the test sufficient time is given to the candidates for preparation to appear in the test against clear as well as anticipated vacancies.
Whether the shorthand test for promotion to the post of Sr. steno held on 06/02/2013 was for anticipated vacancy or for clear vacancy available then? It was for both clear & as well as anticipated proposed vacancies.
Kindly provide the copy of the rule(s) wherein it is mentioned that for anticipated vacancy(s) of next financial year the candidates(s) who will be eligible in the next financial year will not be considered to appear in the competitive steno test/DPC to be held in the next financial year. After the test is conducted, DPC considers the candidates, who had qualified the test, with ACR gradings and Vigilance Clearance. The panel, recommended by DPC, remains valid for one year, as per RRs.’
Kindly specify that in ITPO the DPC(s) are held on the basis of financial year or on the basis of calendar year vacancies. Financial year.
Kindly provide the year wise details of the vacancies of Sr. Stenographers will be available from April, 2013 to December, 2015 under test quota and under competitive test quota separately. Whether any competitive test and DPC can be held in non-availability of clear vacancy in a financial year. DPCs are organized for filling up the vacant as well as anticipated vacancies in a year.
Kindly mention the time period for filling up the vacancies under test quota for the post of Sr. Steno. No specific time period.
Kindly specify the rules for conducting test for anticipated vacancies in a year for promotion to the post of Sr. Steno under test quota and competitive test quota. Test is conducted as per RRs.
Kindly mention the rule applicable in ITPO for preparation of panel for anticipated vacancies for promotions /DPCs departmental competitive test. etc. As per Govt. of India Guidelines.
Kindly clearly mention the rule applied during the promotion of one senior steno.  In June 2013 (steno test held on 6.2.2013) and preparation thereon.  Kindly also provide the certified copy of the rule if any, available in ITPO in this regard. As per Recruitment Rules.
