With reference to the quoted lines, please provide information on the following points, under the RTI Act, 2005: 1. Was the information given in quotes above sought from MMTC in writing? No.
2. If yes, please provide a copy of the confirmation received from MMTC. Not applicable in view of reply given at Sl. No.1 above.
3. If not, was it enquired verbally from MMTC? Yes.
4. If yes, please name the officer of ITPO who enquired the above given information from MMTC and the name of officer in MMTC who provided the information, as recorded in note sheets of relevant file. 5. Please provide copy of the note sheet(s) submitted by the officer of ITPO giving the above quoted information for preparation of Agenda Point for the 185th Meeting of the BOD, ITPO. Ex-DGM (Shri P.P. B. Reference ITPO Letter No.1(P-339)Admn./ 79-Vol.II date 03/05.09.2014 addressed to the undersigned. In this letter, Number of HPL credited in my name has been shown as 135 days. In this context, please provide information on the following points: a) Where this figure of 135 days HPL has been taken from? Please provide copy of relevant note sheets showing this figure. b) Name of the official(s)/officer(s) who worked out, verified this figure of 135days HPL and calculated the amount payable accordingly. c) Is the figure of 135 days HPL credited in my name at the time of retirement correct one? If not, then what was the number of HPL credited in my name at the time of retirement? If there is another figure, please name the officer who submitted the wrong figure of HPL for communicating to the undersigned. d) The revised calculation of payment towards Terminal Leave Encashment has been worked out to Rs.73243. How has this calculation been done in relevant file, please provide details, as per records. I have met a number of retired employees of ITPO, who also informed me that wrong figure of HPL and thereby revised calculation has been communicated to them." 2. ITPO/RTI/09/02/2015 Shri A.K. Gupta, Delhi An advertisement was circulated for the post of GM/IT vide No. 1-ITPO(I)/E-I/2010 dated 13/01/2015. 1. Nothing has been held regarding the further proceeding in this case. It is requested that proceedings held by finalization may kindly be provided. Bachelor's Degree not indicated. Bachelor Degree presumably in Commerce. Hence, not considered.
2. List of candidates applied for this post and further disposal of these candidate may please be provided. 1.Sh Rajender Prasad, 2. Sh. S.F. Ahmed, 3.Sh. V. Venkatasubrananian, 4.Sh. P. Subbiah, 5. Sh. Gulzar A. Mujawar, 6.Sh.Akshay Kapoor, 7.Sh. Jayanta Das, 8.Shri Prem Singh. 9.Shri A.C. M Kumar. The eligible candidates were interviewed and no one was considered fit by DSC for the said post.
3. ITPO/RTI/09/03/2015 Shri Deepak Kumar Jaitly, New Delhi While Shri V. Kumar was posted in the travel unit of ITPO, various airline have the scheme of offering a complimentary air ticket on purchase of 5 or more tickets. 1. It may be intimated as to how many such complimentary air ticket were provided by the various airlines to ITPO. 2. It may be informed as how these complimentary tickets were utilized and for whom. Detailed list of beneficiaries may please be provided. 3. What was the criterion utilizing the complimentary air ticket. In this context, this is to inform that Travel Unit has no record of such tickets provided by any airline during the tenure of Mr. V. Kumar.
4. ITPO/RTI/09/04/2015 Shri Banarasi Ram, Delhi Please provide the certified copy of action taken report vide my letter dated 26.08.2015 with regard to Law Division is corrupt to CMD, ITPO. Copy of letter dated 26.08.2015 is enclosed. This is to inform that your above said letter was filed.
5. ITPO/RTI/09/05/2015 Shri Jayanta Das, New Delhi Kindly refer to reply sent by ITPO to the query raised under letter dated 26.05.2015. I would like to request to supply the information for the following: (a) Is it true that the extension of Ms. Meenakshi Singh as OSD for further period of one year till 31.7.2016 has been approved by the Cadre Controlling Authority CBDT, if yes, copies of the communication received from the competent authority may please be made available to the undersigned on cost basis. Photocopy(1 page) of letter dated 6.05.2015 of CBDT, New Delhi, is available with RTI Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi.
(b) Further it has been informed that she has been cleared by the competent authority from the vigilance angle before joining ITPO as OSD. Copies of the vigilance clearance may please be supplied on cost basis. Photocopy(1page) of letter No. A.35012/3/2011-Ad.VI dated 12.04.2012 received from CBDT, New Delhi, is available with RTI Cell, ITPO, New Delhi.
(c) Further it has been mentioned in the reply that Meenakshi Singh joined ITPO on 08.06.2013 for a period of 13 months. Board of Directors ITPO has approved her extension for a period of two years i.e. 31.07.2015 and also Minutes of the Meeting of Board of Directors ITPO wherein this issue was discussed and approved including the name and designation of the participants. Photocopy (1 page) of Extracts of Minutes of 192nd BOD meeting held on 27.5.2015, is available with RTI Cell, ITPO, New Delhi.
(d) Extension beyond 31.07.2015 i.e. upto 31.07.2016 was approved by the BOD - ITPO on the basis of clearance received from CBDT the cadre controlling authority. Copies of the Minutes of BOD including copies of cadre clearance received from CBDT on cost basis. You may refer to reply given at point (a) above.
(e) It has been mentioned that ITPO is Public Sector Enterprise and is being governed by Department of Public Enterprise (DPE). In the instance case whether approval from the DPE has been sought, if yes copies of the same may please be supplied on cost basis. Yes. The matter is being followed up with DPE/ DOC. Exemption is still awaited.
(f) Also copies of deputation order wherein it has been mentioned that BOD -ITPO has the right to extend the deputation period for fifth year may also be supplied on cost basis. Photocopy (1 page) of Govt. Rule, is available with RTI Cell, ITPO, New Delhi..
6. ITPO/RTI/09/06/2015 Shri Jayanta Das, New Delhi The requisite information received from CBDT vide F.No. HRD/CM/178/1876/2015-16/2784 dated 31.07.2015 has been disposed of by the Department that the nature of the query and clarification in nature is outside the purview of the RTI Act and the public information officer is not supposed to create information or to interpret information or to issue any clarification thereof. Further CPIO is not the custodian of any such record of information on the issues raised by the applicant. In order to facilitate CPIO, I would like to know the following from the available record with the Department; (a) Whether OSD(MS) was suspended by Shri Aklesh Singh, Commissioner of Income Tax, Lucknow? If yes, the reasons thereof. (b) The total period of suspension. (c) When and why the suspension was revoked. (d) Would also request to supply the copies of the order of revocation. It has been conveyed by the Division concerned that no such information pertaining to a.b.c. and d is available in the file of ITPO
7. ITPO/RTI/09/07/2015 Mr. Leonard John Kannur On behalf of the health of the entire nation health to stop adulteration of Cassia instead of True (Ceylon) Cinnamon. Refer letter dated 15.12.2014 to Commissioner of Customs ( as per FSSAI), New Delhi letter dated 15.09.2014). It is to be ensured that no non-edible varieties of CASSIA are not allowed through Port of Entry, not all varieties of CASSIA. For the purpose samples are taken from each and every consignment of Import of CASSIA and sent to the Referral Food Labs. Only after receiving the clearance certificate from Referral Food Lab the consignment is cleared. Refer letter No. 5581/GR/2014 date 04.12.2014, Kings Food Lab, Chennai all samples of CASSIA bark tested NEGATIVE for UGENOL POSITIVE FOR COUMARIN. Refer www.fssai.gov.net. Difference between CASSIA and Cinnamon (Coumarin high in Cassia and low in Cinnamon (Ceylon) or refer www.ceyloncinnamon.com. It clearly states 5% Coumarin in Cassia and 0.004% Coumarin True (Ceylon) Cinnamon. So no Referral Food Lab any where in this world can give clearance certificate to CASSIA. So urgently within 7 days give the written action taken (legal) under FSSAI Food Adulteration Act 2006 (Six months to Life imprisonment with fine upto 10 lakhs) against importers of CASSIA from 01.07.2014 to 29.07.2015. In this context, this is to inform that the information sought/matter does not pertain to ITPO, as India Trade Promotion Organisation(ITPO) does not deal with import and export of commodities as also policy formulation. ITPO organizes trade promotion activities in India and abroad through trade fairs/exhibitions.
8. ITPO/RTI/09/08/2015 Shri Chandra Shekhar Sharma, Delhi With reference to the recruitment in the Organization under your Ministry i.e. India Trade Promotion Organisation. Advt. No. 4-ITPO(6)/E-I/2013 dated 10th June 2013 for the post of Dy. Manager (General Cadre), I request you to please provide me the below details: 1) Final list of candidates including Name, category from rank 1 to 15 with marks (written & interview separately). List (2 page) of Dy. Manager(GC) containing 41 names with category and written Test/Interview marks, can be obtained from Right to Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi – 110 001 by depositing Rs.4/- towards photocopying charges of 2 page @ Rs.2/- per page.
2) Name of the last candidate who joined the organization from the above list. Shri Praful S. Nair joined on 01.09.2015.
3) My rank/position & marks obtained in written and interview in the final list prepared after interview. You may refer to the list at Sr. No.1 above.
9. ITPO/RTI/09/09/2015 Shri Sanjay Azad, Ghaziabad Under the above mentioned subject, I would request you to provide the following information with (certified copies) :- 1. Property return for the year 2014-15 or latest of following employees: a. Shri A.C.M. Kumar, Sr. Manager b. Smt. Deepa Sharma, Manager c. Smt. Sapna Joniwal, Manager d. Shri Ravi Pareek, Manager In this context, this is to inform that the detail of Property Return contains personal and confidential information of an individual qualifies for protection from disclosure u/s 8(1)(j) of the RTI Act 2005. Moreover, as per provision u/s 11 of the RTI Act 2005, the written submission from third party(s) has been obtained and they have refused to disclose their personal information to anybody; therefore, details of their property returns cannot be provided.
10. ITPO/RTI/09/10/2015 Shri Ravi Pareek, New Delhi Kindly take reference of circular of Administration Division –III dated 14th September 2015 for allotment of flat at Asiad Village, New Delhi. I may kindly request you the following information: 1. When was/were the similar expressions invited in the past for allotments? Request you to kindly provide the copies of Circulars. And, who applied for this/these? Photocopies (5 pages) of circulars issued earlier in this regard, can be obtained from RTI Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi – 110001. Senior Manager and above applied against the Circular.
2. What was the criteria for allotment for expressions invited in Q.No.1. Kindly provide the copy of related policy/clause? We may provide photocopy (5 page) of rules and regulations of allotment of flat, as provided by Admn. to the applicant.
3. At present refer circular dated 14th September 2015, what is the allotment criteria? Kindly provide the copy of related policy/clause. Applicant may refer to Clause II of the documents mentioned at Sr. No.2 above.
4. Are the officers or their spouse who already have a flat/house in Delhi eligible for allotment of flats in Asiad Village? If yes, under which clause/rule (kindly provide copy of clause/rule)? Will this not encourage them to let their flats/property out on rent and deprive an officer who do not have a house/property in Delhi? Yes. Rule (iii) of (iii). Allotment of flat is done as per the existing rules and regulations of ITPO.
5. How many flats are vacant at present? At present, there are two flats are vacant. One flat No.601 recently allotted to Shri A.C.M. Kumar, SM and other flat No.A 33 is vacant. As per rules, this flat is allotted to ED and CMD.
6. How many expressions of interest have been received and from whom? Please provide their current residential address along with status of ownership of this accommodation? 1)Shri ACM Kumar, Sr Manager 2) Smt. The residential address and its ownership is a personal and confidential information, disclosure of which would cause unwarranted invasion of privacy of an individual, qualifies for protection from disclosure, u/s 8(1)(j) of the RTI Act, 2005. Hence, cannot be provided.
7. Who is the competent authority for approving allotment at present? ED is the competent authority for approving allotment of flat.
8. Can these flats be allotted on the basis of a draw? There are no such rules for allotment of flat.
11. ITPO/RTI/09/11/2015 Shri Gopal Prasad, Delhi Under the Right to Information Act 2005, Please provide me the following regarding Aahar – 2015 Delhi :- 1. No. of Co-Associates in Aahar Delhi 2015 & Aahar Bengaluru 2015. The information in respect of point No.1 & 2. (a,b,c,d) regarding Aahar, 2015, Delhi, has already been provided to you vide DPIO, ITPO letter No. ITPO/RTI/05/02/2015 dated 08.06.2015. Aahar, 2015, Bangaluru No. of Co-Associates: 03. (Three)
2. Please give the below details of each co-associate separately for Aahar Delhi 2015 & Aahar Bengaluru. a) Please provide details of area demanded (in sq.mtr.) by Co- Associates from ITPO Please mention the details of Co-Associates individually). b) Please provide the details of Space/Area allotted (in sq. mtr.) to Co-Associates from ITPO Please mention the details of Co-Associates individually). c) Please provide the details/percent of area sold by Co-Associates (Please mention the details of Co-Associates individually). d) Please provide the details of area surrendered by Co-Associates (Please mention the details of Co-Associates individually). Thus, technically no surrender can be accounted for
3. a) Please provide the desired Registration No. of Your Co- Associates with the Registrar of Society along with date of Registration and details individually. b) Please provide the desired PAN No. of the Co-Associates and date of Registration. The details of Registration and PAN Number of Co- Associates is personal and confidential information of third party, disclosure of which would cause invasion of privacy of an individual, hence, cannot be provided u/s 8(1)(j) of the RTI Act, 2005.
12. ITPO/RTI/09/12/2015 Shri D.S. Bist, Delhi (1) Diwali advance was granted to ITPO officials for the year 2008-09 to 2013-14 in anticipation of its regularization. Whether the same has been regularized? No.
(1.1) If yes, copy of decision of the appropriate authority may kindly be provided? Not applicable in view of reply given at Sr. No.1 above.
(1.2) If no, what are the reasons behind it? Appropriate Authority/Ministry/ Departments concerned with the approval of regularization of advances granted may kindly be informed. Whether, the proposal for regularization of advances under reference have been submitted to these Authorities/Ministry/ Departments? If so, the decisions of these Authorities/Ministry/ Departments may kindly be conveyed. ITPO has sent the letter to DOC for its regularization. Reply from DOC is still awaited.
(1.3) If there is any Administrative delay? If so who is responsible for the same. There is no Administrative delay. Auditors raised point that PRP cannot be given in ITPO. In this regard, letter was sent to DOC and reply is still awaited.
13. ITPO/RTI/09/13/2015 Banarasi Ram, Delhi Please furnish the following documents related to ad-hoc appointment of Shri V.K.L Chaurasia to the post of Asstt. Manager against advertisement in 1987 are as under: (i) Certified copy of advertisement to the Reserved Category SC/ST to the post of Asstt. Manager indicating date of advertisement – copy received without indicated date. As per available record, photocopy of Advt. has already been provided to you.
(ii) Copy of Application submitted by Shri Chaurasia. Photocopy (1 page) of Application (Biodata) dated 21.4.87 of Shri VKL Chaurasia, can be obtained from Right to Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi. Copy of the document shall be provided to you, by severing the personal information of third party i.e. residential address, as per provisions u/s 10 of the RTI Act, 2005.
(iii) Copy of caste certificate of ST submitted by Shri V.K. L. Chaurasia. The document of caste certificate contains personal and confidential information, of the third party, disclosure of which would cause unwarranted invasion of privacy of an individual, qualifies for protection from disclosure. Moreover, the third party has refused to disclose his personal information to anybody. Hence, the information sought by you, cannot be provided u/s 8(1)(j) and 11 of the RTI Act, 2005.
(iv) Copy of calling interview letter held on 16.02.89. Photocopy(1 page) of Interview letter dated 27.01.1989 issued to Shri V.K.L.Chaurasia, can be obtained from RTI Cell, ITPO, New Delhi. Photocopy of letter shall be provided by severing personal information of third party i.e. residential address, as per provisions u/s 10 of the RTI Act, 2005.
(v) Copy of the minutes of Departmental Selection Committee (DSC) held on 16.02.89 to the post of Asstt Manager & DSC Minutes proceedings are confidential in nature. You were not the affected party in this case; hence, cannot be provided as per provisions u/s 8(1)(j) of the RTI Act, 2005.
(vi) Copy of order regarding regularization against ad-hoc appointment of Shri Chaurasia to the post of Asstt. Manager on 14.08.89. The applicant further stated that "If necessary inspect the original documents after receiving the documents." Photcopy (2 pages) of Office Order No.1266/2006 dated 27.09.2006 confirming regularization from date one of appointment/Promotion in respect of Asst. Manager (GC), can be obtained from RTI Cell, ITPO, New Delhi.
