Details of Queries/Replies for the month of October, 2015 under RTI Act

2. Reason for non-payment of leave encashment . Not applicable.
3. Provide the list of all the officers/officials including unionized staff, who joined TFAI in March 1977 and were paid leave encashment on account of leaves transferred from their respective offices. The details, as per available records of the three officials who joined TFAI in 1977, is as under: Smt. Rashmi Kalia had got her leave encashed, as per service book record. Madam Mahesh did not have any leave. Shri Gulab's leave were adjusted. The detail of other officials who joined in 1977, is not traceable.
2. ITPO/RTI/10/02/2015 Shri Shekhar Bhatt New Delhi Particulars of current pending court cases in which Govt. is in litigation with parties like a private person or a private firm or a Society or a Trust or a Private Company or an NGO or private institution indicating:
  • Case number and name of such party/s and
  • Cause of action in each case
List (4 pages) of pending cases, showing Court/Case No, issues involved, present status, can be obtained from Right to Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi – 110 001, by depositing Rs.8/- towards photocopying charges of 4 pages @ Rs.2/- per page.
Please also indicate the particulars of the courts or tribunals where all the cases referred at Serial No.1 are pending or are in progress – State wise. There is one case in the matter of ITPO Vs. M/s Prakriti Trading Pvt Ltd in the Bombay High court – State wise.
Out of the above cases, please separately indicate those cases which have been referred to Arbitration/ Mediation/ Concililation / Lok Adalat, etc. by Courts under Section 89 of Cr. PC – State wise. As on date, there are no cases referred to Arbitration / Mediation / Conciliation / Lok Adalat, etc., by Courts under section 89 of Cr.PC – State wise.
3. ITPO/RTI/10/03/2015 Shri Sachin Kumar, Delhi What are the rules & formalities for events organized by ITPO itself. ITPO as an organizer, plans a fair at Pragati Maidan for which dates/halls are approved by competent authority. These dates/halls are earmarked by BDD for the approved fairs of ITPO at Pragati Maidan. Thereafter, event is organized on approved dates/ halls. In case event is cancelled/postponed due to some reasons, the same is approved by competent authority. Since ITPO itself owns Pragati Maidan, ITPO does not raise any invoice to itself for venue rentals/ penalty etc. Since you have not indicated the name of the event for which rules and regulations are required, photocopies (17 pages) terms and conditions for participation in IITF 2015, can be obtained from Right to Information Cell, India Trade Promotion Organisation, Pragati Maidan, New Delhi by depositing Rs.34/- towards photocopying charges of 17 pages @ Rs.2/- per page.
Why difference in rules & formalities between events organized by ITPO and other organizers? Seeking clarifications is not covered under the ambit of "Information" as defined u/s 2(f) of the RTI Act, 2005. However, it has been informed by the Division concerned that ITPO's fairs and third party fairs in Pragati Maidan are two different services provided by ITPO. Therefore, the rules may be different for two different services. In case of third party fairs i.e. organized by other agencies, the organizers are invoiced by ITPO for venue rentals, services, cancellation/ postponement penalty, etc.

एस. डी. एम. सी. को पी. एफ व ई एस आई की वजह से निकाला गया था तो क्या हाल न. 7 से 11 तक जो एजेंसी काम कर रही है वह पी. एफ. व ई. एस. आई देते है ? यदि हाँ तो ठेकेदारों का नाम और उनकी पी. एफ व ई एस आई की लिस्ट प्रदान की जाये । हाल न. 7 से 11 का सफाई का कार्य M/s Scan Guard Protection Services कर रही है । तथा वह ESI /EPF देती है जिसका लिस्ट (3 पेज) प्रार्थी आर टी आई सेल, आई टी पी ओ, प्रगति मैदान, नई दिल्ली से प्राप्त कर सकता है ।
हाल न. 7 से 11 तक जो पुताई का कार्य कर रहे है वह पी. एफ व ई एस आई देते है अगर देते है तो उन एजेंसी का पी. एफ व ई एस आई की रजिस्ट्रेशन की कापी दी जाए हाल न. 7 - 11 तक जुलाई का कार्य M/s Krishna Construction Co. कर रही है । तथा वह PF/ ESI देते हैं । एजेंसी का पी. एफ रजिस्ट्रेशन न. DL,18818 व ई एस आई की रजिस्ट्रेशन न.11-42733-101/Zone-5.
प्रगति मैदान मे जो एजेंसी सडक व पार्क का कार्य कर रही है वह पी. एफ व ई एस आई का भुगतान करते है तो उनकी लिस्ट की कापी दी जाये । प्रगति मैदान में सडक व पार्क का सफाई का कार्य M/s BVG India Pvt Ltd कर रही है । जो PF/ESI का भुगतान करते हैं। उनके लिस्ट (4 पेज) प्रार्थी आर टी आई सेल, आई टी पी ओ, प्रगति मैदान, नई दिल्ली से प्राप्त कर सकता है ।
प्रगति मैदान मे एस. डी. एम. सी. की हाजिरी चैक कराई गयी थी उनका विवरण एस. डी. एम. सी. में भेजा था उनकी कापी दी जाये । प्रगति मैदान में SDMC की हाजिरी चेक करने के बाद जो लेटर आई टी पी ओ कि और से भेजा गया वो कापी (4 पेज) प्रार्थी आर टी आई सेल, आई टी पी ओ, प्रगति मैदान, नई दिल्ली से प्राप्त कर सकता है ।
श्री ए.के. जोशी एस. डी. एम. सी. का कार्य देख रहे है वह एक साल की हाजिरी, मस्टरोल व पेमेनट की डिटेल प्रदान की जाये । SDMC एक साल की हाजिरी(12 पेज) व पेमेंट (1 पेज) का विवरण प्रार्थी आर टी आई सेल, आई टी पी ओ, प्रगति मैदान, नई दिल्ली से प्राप्त कर सकता है । SDMC मस्टरोल अपने पास रखती है वो हमारे पास उपलब्ध नहीं है।

ITPO/RTI/10/05/2015 Shri Sant Lal Yadav, New Delhi Kindly provide the certified copy of the letter No. F.No.ITPO/PR/Misc./2011-12 dated 22.03.2013 and F.No.18/ITPO/F&B/Inv./2011-12 (K-4 Palace Restaurant) Pragati Maidan, New Delhi. Copy enclosed It has been conveyed by the Division concerned that they have checked its file records thoroughly but the file Nos. / correspondence mentioned by you is not available in the records. Further, the address mentioned on the photocopy of letters enclosed by the applicant is also not found. The registered address of Palace Restaurant on which the licence Agreement was executed between the ex-licensee and ITPO was 17/2, Kalyan Puri, Delhi – 110091. However, the address mentioned on the photocopy of letters enclosed by you was altogether different from the registered address of Palace Restaurant as per available records.
Kindly also verify is that said property is still running by the Palace Restaurant /expired/terminated (if it terminated then please mention the date/month/year) Palace Restaurant was allotted Kiosk No.4 at Pragati Maidan for the period 3.11.2000 to 2.11.2007. After expiry of the licence term period, Palace Restaurant did not vacate the licensed premises as per direction of the Hon'ble Delhi High Court vide its order dated 05.10.2007. Later, Palace Restaurant vacated the premises (Kiosk No.4) on 10.06.2011.
6. ITPO/RTI/10/06/2015 Shri Sunil Muralidhar Deshpande, Mumbai 1. Whether the Office Memorandum No.4/1/87-P&CI dated 01/05/1987 issued by Ministry of Personnel Public Grievances and Pensions issued on the subject of "change over the Central Govt. employees from the contributory provident fund scheme to the Pension Scheme – implementation of the recommendation of the 4th Central Pay Commission" issued to all Ministries including Ministry of Commerce was also issued and forwarded to all autonomous bodies more particularly under the Trade Promotion Section also Indian Institute of Packaging, Mumbai, then the compliance and for necessary action Pertains to Ministry of Commerce & Industry.
2. If the answer is yes a copy of the Office Memorandum preferably with the outward dispatch number and date then forwarded to Indian Institute of Packaging.
3. Was any written communication from Indian Institute of Packaging then received on aforesaid subject.
4. How many number of organizations then had responded and implemented the Pension Scheme along with their names under your administrative control. India Trade Promotion Organisation comes under IDA patterns pay scales. Hence, not applicable.
7. ITPO/RTI/10/07/2015 Shri Sanjeev Kumar Delhi 1. I want to inspect the file(s) where approval for transfer of six posts of Sr. Stenos, were made from Ex-TDA Cadre to Ex-TFAI/ITPO and on O/o No. 899 dated 18.08.2004 was issued and also want the certified copies of the notings and correspondences pages, if needed. Shri C.P. Maithani, Executive, Admn. Divn. has been nominated to arrange inspection of relevant file. You may inspect the same on 4th December, 2015 at 3.30 p.m. The inspection shall be conducted in RTI Cell, ITPO, Pragati Maidan, New Delhi. You may please note that for inspection of file(s), no fee is charged for the first hour and a fee of Rupee five is charged for each subsequent hour (or fraction thereof) thereafter.
2. I want to inspect the file where approval for transfer of three posts of Sr. Steno, were made from Ex-TDA Cadre to Ex-TFAI/ITPO Cadre in 2007 and also want the copies of the notings and correspondences pages, if needed.
3. Please specify the Designation of the Competent Authority who is empowered to make changes in the Rosters (Text/Seniority) maintained for Sr. Steno and whose approval is required after any change/revision in the rosters. Allotment of quota for seniority/ test is as per Recruitment Rules.
4. Kindly provide the certified copy(s) of the approval of the Competent Authority where posts of Sr. Steno were revised under Test Quota 17 to 16 and under Seniority Quota from 16 to 17 and also want to inspect the concerned file. You may refer to reply given at Sr.No.3 above.
5. As per notings of Ex-DGM(MMN) dated 21.03.2015, M(BNG) was directed by Ex-DGM(MMN) to correct the roster as he has revised the roster under Test Quota from 17 to 16 and under Seniority Quota from 16 to 17 (Annexure-I), Kindly provide the copy of justification/clarification in this regard made by M(BNG), if any. As specified above.
6. I want to inspect the file pertaining to 'reply of stenographers' and want the certified copies of the notings and correspondences page, if needed. Your query is not clear. However, you may specify the particular file/ case for inspection.
7. Whether at the time of transferring of these above mentioned posts in 2004 and 2007, the approval of BOD was sought, if yes, kindly provide the agenda notes and minutes of the said meetings. You may refer to reply given at Sr. No.1 & 2 above.
8. Whether the reduction of one post of Sr. Steno, under Seniority Quota from 17 to 16 was accepted by the then DGM(MMN), if yes, kindly provide the certified copy of the document where the same was accepted by then DGM(MMN). The quota allocation is as per RRs and the factual position was brought in the notice of the then DGM(Admn) by the then M(Admn.).
9. How many posts of Sr. Stenos, were transferred from Reserved Quota i.e. SC/ST to General Cadre from 2000 to 2015?" As per roster, two cases of de-reservation were made.
8. ITPO/RTI/10/08/2015 Sh. Banarasi Ram Delhi 1. Please provide the certified copy of Special Audit Report with regard to irregular appointment of Shri V.K.L.Chaurasia to the post of Asstt. Manager on 14.08.89. It has been conveyed by the Division concerned that no such Special Audit Report with regard to irregular appointment of Shri V.K.L. Chaurasia is available.
2. In accordance to Scrutiny Committee Report, provide the list of SC/ST candidates to the post of Asstt. Manager were called for interview/ written test held on 16.02.1989 against advertised for Reserved Category of SC/ST in 1987. It has been conveyed by the Division concerned that no Scrutiny Committee Report is available in the relevant file.
9. ITPO/RTI/10/09/2015 Shri Hans Raj Kain, New Delhi Please inform whether in the event/fair organized by 3rd party, internet/wi-fi service is provided by ITPO to the event organizer/participants." In this context, this is to inform that ITPO does not provide any Internet/ Wi-Fi service to the 3rd Party Fair Organizer during their events being organized in Pragati Maidan.
